Are Bioethanol Fireplaces Legal in the Northern Territory

Short answer: Yes. A bioethanol fireplace sold in the NT follows the same national law as every other state: the Consumer Goods (Decorative Alcohol Fuelled Devices) Safety Standard 2017 (F2017L00909). The NT has no current statute naming bioethanol fireplaces. What actually differs up here is the shape of the fire season itself, since it runs on the dry season rather than the summer window used down south.

A 2016 ban that no longer applies

Before the national standard existed, the NT acted alone. NT Consumer Affairs issued an interim 60-day ban on portable and table-top alcohol-fuelled burners in December 2016, after more than 100 reported injuries and 115 fire incidents nationally since 2010. That ban was superseded once the national standard commenced on 15 July 2017; a portable bioethanol burner is not banned in the NT today, provided it meets the same standard as every other state. The 2016 notice is history, not current law.

Fire bans and fire danger periods run on the dry season

The Territory splits bushfire risk into two tiers under the NT Government's fire bans and fire danger periods rules. A fire ban is short and strict: up to 24 hours, every permit to burn void. A fire danger period runs longer, with supervised burning allowed under a permit. During a ban, only a gas or coal barbecue stays permitted, plus a small cooking fire kept 4 m clear of anything flammable.

South Australia's CFS Fire Danger Season runs November through April, by contrast. The NT ties its calendar to the dry season and grassland curing rates instead, roughly opposite the southern summer.

The NT's fire-ban page never mentions ethanol or a decorative fireplace by name. It does not need to: during a fire ban, "you must not start fire in the open air". A bioethanol fire feature lit outdoors is a fire in the open air; it is neither a gas or coal barbecue nor a small cooking fire, the only exceptions the page allows.

Apartments and units: no default by-laws to fall back on

Every other state in this series has default strata by-laws for a scheme without its own. The NT does not: under the Unit Title Schemes Act 2009 (NT), confirmed at the Northern Territory Law Handbook's shared ownership chapter, there are no default articles; each body corporate writes its own by-laws. Whether a fire feature is allowed on a balcony or shared courtyard depends entirely on that scheme's rules. Ask your body corporate directly.

Renting works the same way as elsewhere: a portable unit needs no landlord consent, while a fixed installation needs the landlord's written permission under the Residential Tenancies Act 1999 (NT).

The honest verdict for the NT

The Territory's real point of difference is not a bioethanol-specific law, since none exists. It is a fire season on the opposite half of the year to most guides' assumptions, a strata system with no default by-law, and a 2016 local ban now retired to history.
