Can You Have a Fire Pit on a Balcony

Short answer: It depends on permission, not on the fire pit itself. No blanket rule bans a fire pit from an apartment balcony, but most strata schemes require written Owners Corporation approval before an open flame or a stored flammable liquid goes on a lot. A certified bioethanol fire pit is a realistic thing to ask permission for; an open wood fire is not. Neither one is automatically approved just by turning up on the balcony.
That approval step is the part most people skip. It is the one that actually decides the outcome. See our full EcoSmart Fire range for the certified models worth putting in a written request.
Why permission comes before the appliance
Strata lawyers writing for NSW owners corporations describe an open fire on a balcony as "inherently hazardous". That risk can affect the building's own insurance, and it can cause a smoke-drift nuisance for the units around it. Many schemes also carry a standard by-law requiring written Owners Corporation approval before an owner stores or uses an inflammable liquid or gas on their lot. That storage by-law usually carries a carve-out for material used for ordinary domestic purposes; a fuel bottle for a decorative fire pit may or may not sit squarely inside that carve-out. Strata lawyers recommend the simpler path regardless: ask the Owners Corporation in writing before installing anything, rather than argue the exemption afterwards.
Why wood fails on balconies specifically
A balcony has none of the drainage, ember clearance or overhead space a backyard has. Ash and embers from an open wood fire fall straight onto the balcony below, and smoke drifts directly into neighbouring units rather than dispersing across a yard. Queensland Fire Department's own balcony guidance, written for barbecues, makes the same point for any open flame in that setting: use it only in an open, well-ventilated area, since smoke can trigger smoke alarms in confined outdoor spaces. Some apartment buildings also carry combustible cladding, adding a further layer of risk. Between all of it, an open wood fire on a balcony is close to an automatic no in most schemes.

Why certified bioethanol is a more realistic ask
A bioethanol fire pit needs no flue, no gas line and no structural work, which removes most of the reasons a strata committee has to say no on sight. Every EcoSmart fire pit sold through My Acre carries certification against Australia's mandatory Consumer Goods (Decorative Alcohol Fuelled Devices) Safety Standard 2017. That documentation is worth attaching to a written approval request, rather than asking a committee to take the appliance on trust. None of that makes approval automatic; it is closer to asking permission for a substantial barbecue than for an open fireplace. Your own by-laws still apply, and you still request it in writing before you buy.
That certification also does not put a bioethanol fire pit outside total fire ban rules. Victoria's CFA bans all fires for warmth or personal comfort on Total Fire Ban Days, whatever the fuel; every other state and territory does the same. A bioethanol appliance avoids the embers and drifting smoke that worry a strata committee, which makes it easier to approve, not exempt. A balcony also counts as the open air: the CFA defines that as any place not inside a permanent structure with a roof and fully enclosed walls. On a declared ban day, the fire pit stays off.

The honest verdict
Ask the Owners Corporation in writing before you buy, not after. A certified bioethanol fire pit gives a strata committee a genuine, documentable case to approve; a wood fire mostly does not.
